    – Discovery of a “bull’s eye” molybdenum anomaly spanning 2.8 km x 1.6 km, potentially indicating a core porphyry system.

    He noted that Kazakhstan has made great progress in digitalization over the past few years, and this attracts investors.

    — The US agency is in the process of implementing partnership projects to help further develop the mineral potential of Kazakhstan. “I also told companies that I hope that Kazakhstan will take further steps to realize the full potential in the mining sector with a focus on improving investment conditions,” Daniel Rosenblum emphasized.

    The Ambassador also shared his views on how Kazakhstan can maximize its potential in attracting investment.

    — First of all, this is ensuring transparency. Investors love predictability and visibility in decision-making, laws, and taxation. We often hear from private sector partners that they want maximum transparency and equal and fair implementation of laws. This is very important, US investors want to see a fair market so that they are protected from arbitrations and legal proceedings in courts. Of course, we must take into account that investments are opportunities to attract large taxes for the country,” he emphasized.

    Also, he said, American investors want to see the expansion of the private sector in mining to stimulate innovation and create new creative opportunities.

    “It is also very important to improve efficiency and demand accountability from shareholders and managers. In this regard, the government is taking concrete steps to reduce its presence. More privatization in the mining sector will also have a positive impact on the attractiveness of the sector. We look positively on Kazakhstan’s current focus on inviting and stimulating international investment in this sector,” concluded Daniel Rosenblum.

    The most likely outcome, if the concession agreement for the Brskovo mine is terminated, is that the concessionaire, Tara Resources, will initiate arbitration against Montenegro, stated Luka Popović, the lawyer representing the Swiss company.

    He attended today’s meeting of the Interdepartmental Working Group for the preparation of an expert analysis of the concession agreement for detailed geological exploration and exploitation of sulfide polymetallic ore at the exploration-exploitation area of the former Brskovo mine.

    “We emphasized during the work that the Government must be aware that the working group needs to indicate the risks of this procedure and that, if the concession agreement were to be terminated, it is not the only potential risk of domestic court and litigation before a domestic court, but there is a potential risk of international investment arbitration since the investor, the owner of the concession company, is a Swiss company, and considering that there is a mutual agreement between Switzerland and Montenegro on the protection and promotion of investments which gives investors from signatory states the right to initiate arbitration against the other state in case of violation of their rights,” Popović said.

    So far, the working group has discussed the legal aspects of the annex to the concession agreement and the facts that the relevant ministry considers to be relevant for assessing whether there is a breach of the agreement and grounds for termination.

    As the representative of the concessionaire, Popović believes that there is no basis for termination of the agreement.

    “The obligations of the investor at this stage of the concession agreement are to develop project documentation and obtain all permits based on that documentation, and it cannot do so until the Government adopts spatial plans and issues urban-technical conditions as the first document in the permit acquisition process. That is the responsibility of the Government,” Popović added.

    However, this meeting also passed in a tumultuous atmosphere with different conflicting opinions. Councilor in the Municipal Assembly of Mojkovac, Miloš Rajković, reiterated claims that carrying out works on the territory of the former Brskovo mine would have negative consequences for the environment, human health, and the cultural memory surrounding that area.

    “Whoever starts digging and excavating there must know that blood was shed somewhere and that it did not bring him any profit – neither business, personal, family, nor do I believe this issue will end well. They violated the annexes and accepted responsibility for not issuing urban-technical conditions, the contractor withdrew from the draft Detailed Spatial Plan,” Rajković stated.

    Popović dismissed all these accusations and reminded that nothing has changed in the life of the concession agreement since the period when annexes five and six were concluded, extending the deadlines for the completion of the permit acquisition phase.

    “We have provided arguments why none of the allegations made stand and why they are not relevant at this time. Most of the facts related to environmental protection, which were presented during the work of the working group, relate to the period that is yet to come. The discussion about the project’s impact on the environment can come to the agenda when you have a specific mining project that has been revised in accordance with the regulations, and when an environmental impact assessment study is done alongside that project,” Popović explained.

    On 22 February our partners at the Kazakhstan Chamber of Mines (established March 2023) organised their first international conference under the theme “Increasing Investment Attractiveness in Kazakhstan’s Mining Industry”.

    This Astana-based event convened expert panels featuring senior Kazakhstan officials, Senate Parliament representatives, and Ambassadors from the UK, USA, and Canada, alongside national/international mining companies, industry NGOs, and CRISCO/PONEN members.

    Breakout sessions addressed critical issues:

    Legal Framework Impacting Investment: Discussions centred on proposed changes to mineral export licensing, in-country value programs, streamlining exploration territory returns, groundwater deposit regulations, and environmental approval processes.

    Environmental and Subsoil Use Legislation: Amendments to the Subsoil Code (including the Auction Program), revisions to the Environmental Code for faster subsoil use approvals, and the transition to KAZRC were key topics.

    Due to the limited venue capacity, not everyone could attend the conference. The press office of the MINEX Forum’s secretariat prepared a summary of the keynote and side-line interviews.

    Kazakhstan’s mining industry has seen an influx of over $200 billion in investments over the past decade, accounting for 60 per cent of the total investments in the country’s economy. This significant financial commitment underscores the sector’s attractiveness and its pivotal role in Kazakhstan’s economic development.

    Kanat Sharlapayev, the Minister of Industry and Construction, highlighted the vast potential awaiting investors, with 8,000 deposits identified across the nation. More than 100 of these deposits are currently approved for sale, signalling a wealth of opportunities for exploration and development.
    The country has opened up 1.5 million square kilometres for geological research, marking a significant step towards harnessing Kazakhstan’s mineral wealth. This expansion is part of a broader strategy to attract investment by simplifying legislation and procedures related to the mining sector.

    In a significant move towards modernizing its mining sector, Kazakhstan has introduced the KAZRC standard, aligning with internationally recognized standards for geological discoveries. Minister of Industry and Construction, Kanat Sharlapayev, announced this development, emphasizing the importance of speaking a common language with investors to ensure transparency and reliability in reporting standards. The introduction of the KAZRC standard is part of Kazakhstan’s broader efforts to attract investment and enhance the efficiency of its mining industry. Sharlapayev highlighted the country’s commitment to digitization, noting the successful transition to online processes for obtaining exploration licenses. Since October 2023, the ministry has awarded 273 exploration licenses through its digital platform, demonstrating a significant step towards streamlining operations and making it easier for investors to navigate the Kazakh mining environment.

    The minister also pointed out the modest yet significant achievements in the auction process, where international mining giants like Rio Tinto and Fortescue competed for exploration rights in Kazakhstan. This interest from major global players, along with investments from junior miners backed by these corporations, underscores the growing confidence in Kazakhstan’s mining sector.
    Sharlapayev further shared impressive investment trends, revealing that private exploration companies invested over $200 million in geological exploration in Kazakhstan in 2023 alone. Sharlapayev reiterated that prior to 2023 it took five years to attract the same amount of private investment in mineral exploration. This surge in investment is a testament to the effectiveness of the new mining code introduced in 2018 and the country’s efforts to attract fresh capital into its geology sector.

    Addressing the critical importance of reliable supplies of critical materials, the minister assured that Kazakhstan could offer both the materials and the reliability needed by global markets. The country’s mining sector, leveraging its rich natural resources, contributes about 18 to 20 percent of the global aerospace titanium, holds a 30 percent share in the world’s beryllium production, and produces over 10 percent of the global tantalum market. Additionally, Kazakhstan is recognized as one of the top ten copper producers worldwide. The evolution of scientific methods and technological tools in the field of geology holds promise for the discovery of untapped mineral resources within the country. This initiative reflects Kazakhstan’s commitment to expanding its mining sector and strengthening its position in the global market for critical minerals and other valuable resources.
    In conclusion, Sharlapayev reiterated Kazakhstan’s long history and expertise in mining, dating back to the mid-20th century, and highlighted the country’s human capital as a key strength in developing its resources. He expressed gratitude to the international community for their interest and investment in Kazakhstan, underscoring the country’s commitment to becoming a leading player in the global mining industry.

    Sideline interview with HE Daniel Rosenblum – USA Ambassador in Kazakhstan

    U.S. Ambassador to Kazakhstan, Daniel N. Rosenblum, has articulated the significant strides Kazakhstan is making in enhancing its investment climate, particularly within the mining sector. The Ambassador’s remarks came during a sideline interview, where he conveyed a message of progress to American businesses.

    Ambassador Rosenblum, who was sworn in on October 28, 2022, has a rich background in foreign service, including a tenure as the U.S. Ambassador to Uzbekistan and various roles within the State Department’s Bureau of South and Central Asian Affairs. His insights into Kazakhstan’s mining industry are informed by his extensive experience in the region.

    During his visit to the United States in December 2023, Ambassador Rosenblum engaged with numerous mining companies based in Arizona, a leading mining region in the U.S. He emphasized the lucrative opportunities present in Kazakhstan and the mutual benefits that such investments would bring to both countries. The Ambassador underscored the critical nature of minerals, especially those used in renewable energy technologies like batteries, and the strategic importance they hold for the future of both Kazakhstan and the United States.

    Согласно Постановлению, разрешается осуществлять 25 процентов платежей за медное сырье, приобретенное через биржевые торги, в виде аванса, оставшиеся 75 процентов – оплачивать в течение 90 дней после получения медного сырья.   

    При этом, сумма платежей, подлежащих уплате за каждый день предоставления возможности оплаты в рассрочку за медное сырье, устанавливается в следующих размерах: 

    на часть платежей, осуществленных в течение 30 дней, – проценты не рассчитываются;  

    на часть платежей, осуществленных с 31-го дня в течение 60 дней, – рассчитываются проценты в размере 50 процентов основной ставки Центрального банка;

    на часть платежей, осуществленных с 61-го дня в течение 90 дней, – рассчитываются проценты по основной ставке Центрального банка.

    Постановление вступает в силу с 1 апреля 2024 года, и его требования не распространяются на договоры, заключенные до 1 апреля 2024 года.

    Measures will be taken to further accelerate the deep processing of copper raw materials.

    A Presidential Decree “On measures to further accelerate the deep processing of copper raw materials in the republic” (Decree No. 77 of February 19, 2024) has been adopted.

    According to the Decree, it is permitted to make 25 percent of payments for copper raw materials purchased through exchange trading in the form of an advance, while the remaining 75 percent should be paid within 90 days after receiving the copper raw materials.

    At the same time, the amount of payments subject to installment payment for each day of providing the opportunity to pay in installments for copper raw materials is established in the following amounts:

    – for payments made within 30 days, no interest is calculated;
    – for payments made from the 31st day within 60 days, interest is calculated at a rate of 50 percent of the Central Bank’s base rate;
    – for payments made from the 61st day within 90 days, interest is calculated at the Central Bank’s base rate.

    The Decree comes into force on April 1, 2024, and its requirements do not apply to contracts concluded before April 1, 2024.
